North Carolina woman sues after Facebook photo used in beer ad campaign

A woman in North Carolina filed a lawsuit against Anheuser-Busch and a distributor alleging a photo she posted to Facebook is being used to hawk Natural Light without her permission.

Kayla Kraft is the woman against the brewer and Raleigh-based distributor R.A. Jeffreys for posting a photo to Kraft’s Facebook four years ago. The phtoo popped up on coasters, posters, and other promotional materials for the “Every Natty Has a Story” campaign for Natural Light.

The photo shows Kraft wearing a fake mustache and sipping from a bottle of Natural Light.


The suit states Kraft registered the photo with the U.S. Copyright Office.

“Defendants reproduced, distributed, and publicly displayed the Kraft photograph without the authorization or consent of Kraft or (her friend), and have created unauthorized derivative works incorporating the Kraft photograph,” the lawsuit states. “Defendants have engaged in a widespread pattern and practice of misappropriating the names and likeness of others for commercial purposes without permission or compensation.”

The lawsuit accuses the defendants of copyright infringement, invasion of privacy, and violation of the right of publicity.
